These Terms and Conditions set out the basis on which House Clearance Wimbledon provides house clearance and waste collection services to residential and commercial customers within our service area. By making a booking, confirming a quotation, or allowing our operatives to commence work at your premises, you agree to be bound by these Terms and Conditions.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, company, or organisation that requests or receives services from House Clearance Wimbledon.
Services means any house clearance, rubbish removal, waste collection, loading, transport, and related services provided by House Clearance Wimbledon.
Premises means the property, site, or location where the Services are to be provided.
Waste means items, materials, furniture, appliances, and other goods that the Customer instructs us to remove and dispose of or recycle.
Contract means the agreement between the Customer and House Clearance Wimbledon incorporating these Terms and Conditions and any written quotation or booking confirmation.
House Clearance Wimbledon provides house clearance and waste collection services including, but not limited to, the removal and transport of domestic and commercial waste, unwanted furniture, appliances, and general clutter from within our service area.
We reserve the right to refuse removal of any item that we reasonably believe to be hazardous, illegal, unsafe to handle, or prohibited under waste regulations. This includes certain chemicals, asbestos, medical waste, pressurised containers, or items suspected to be stolen or unlawfully possessed.
The exact nature and scope of the Services will be set out in a quotation or booking confirmation provided to the Customer prior to the commencement of work.
3.1 Initial enquiry
Customers may request a quotation by telephone, email, or enquiry form, providing accurate details of the Premises, access arrangements, parking availability, and an approximate description or volume of Waste to be removed.
3.2 Quotations
Any quotation provided is based on the information supplied by the Customer and is subject to change if, upon arrival, the volume, weight, or nature of the Waste differs materially from the description, or if access or parking conditions are different from those stated.
Quotations may be given as a fixed price, a price range, or a price based on estimated volume or weight. All prices are provided exclusive of VAT unless stated otherwise.
3.3 Acceptance of booking
A booking is accepted, and a Contract is formed, when the Customer confirms acceptance of our quotation and we issue a booking confirmation, or when our operatives attend the Premises and the Customer permits work to commence.
3.4 Access and parking
The Customer must ensure that we have suitable access to the Premises at the agreed time and that reasonable parking is available for our vehicle. Any parking charges or penalties incurred due to insufficient or restricted parking arrangements may be added to the final invoice and must be paid by the Customer.
The Customer agrees to:
Provide accurate information regarding the type and quantity of Waste, access conditions, and any potential hazards.
Ensure that an authorised adult is present at the Premises during the scheduled time to grant access, give instructions, and sign to confirm completion of the Services.
Secure all valuables and personal belongings not intended for removal and clearly separate them from items to be taken away.
Comply with all applicable laws and regulations in relation to the Waste handed over to us, including ensuring that it is lawfully in their possession and may be disposed of.
House Clearance Wimbledon will:
Provide the Services with reasonable care and skill, using trained operatives and appropriate vehicles, equipment, and protective measures.
Use reasonable endeavours to arrive at the Premises at the agreed time or within any stated time window, subject to traffic, weather, and other conditions beyond our control.
Handle Waste responsibly and transport it to licensed waste transfer stations, recycling facilities, or other lawful disposal or reuse outlets in accordance with applicable waste regulations.
Maintain valid waste carrier registration and any other licences or permits required for the performance of the Services.
6.1 Pricing basis
Service charges are usually based on a combination of the volume, weight, type of Waste, the labour required, access conditions, and any additional services requested, such as dismantling or extra sorting.
6.2 Additional charges
Additional charges may apply for:
Excess volume or weight beyond the original estimate.
Difficult or restricted access that significantly increases loading time.
Parking costs or penalties incurred while undertaking the Services.
Special handling of heavy, bulky, or hazardous items where lawful and agreed in advance.
6.3 Payment terms
Unless otherwise agreed in writing, payment is due immediately upon completion of the Services. We accept payment by cash, bank transfer, or card, subject to availability at the time of service.
For business customers or larger projects, we may agree to issue an invoice with specified payment terms. Late payments may incur interest and reasonable recovery costs.
6.4 Non-payment
If the Customer fails to pay sums due, we reserve the right to suspend further Services, charge interest at the statutory rate on overdue amounts, and take steps to recover the debt, including legal action where necessary.
7.1 Customer cancellations
The Customer may cancel or reschedule a booking by notifying us as early as possible. Where at least 24 hours notice is given before the scheduled arrival time, no cancellation fee will normally apply.
Where less than 24 hours notice is provided, or if our team arrives and is unable to gain access or start work for reasons within the Customer's control, we reserve the right to charge a cancellation or failed attendance fee to cover wasted travel and time.
7.2 Amendments
If the Customer wishes to change the date, time, or scope of the Services after booking, we will use reasonable efforts to accommodate the change, subject to availability. Any additional costs resulting from changes may be added to the final price.
7.3 Cancellations by us
We may cancel or postpone a booking where performance of the Services is affected by circumstances beyond our reasonable control, including severe weather, traffic incidents, illness, accidents, or issues affecting access or safety at the Premises. In such cases, we will offer to reschedule the booking at the earliest reasonable opportunity.
8.1 General liability
We will exercise reasonable care when carrying out the Services at the Premises. However, minor marks or scuffs that may occur when removing large or heavy items through narrow spaces may not be avoidable, and we will not be liable for such minor cosmetic damage, provided we have acted with reasonable care and skill.
8.2 Exclusions of liability
We will not be liable for:
Loss of or damage to any item that the Customer has not clearly identified as valuable and specifically instructed us not to remove.
Loss or damage arising from defects in the structure, fixtures, or fittings of the Premises.
Indirect or consequential losses, including loss of profit, income, or business opportunity, arising from or in connection with the Services.
Any loss or damage caused by inaccurate information provided by the Customer regarding the nature of the Waste or access conditions.
8.3 Limitation of liability
Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
Subject to the above, our total liability to the Customer for any loss or damage arising out of or in connection with the Contract shall be limited to the total price paid or payable by the Customer for the relevant Services.
9.1 Legal compliance
House Clearance Wimbledon operates in accordance with applicable waste management legislation and environmental regulations. We are a registered waste carrier and will transport and dispose of Waste only at authorised facilities.
9.2 Title to Waste
Ownership of Waste transfers from the Customer to us once it has been loaded onto our vehicle. The Customer warrants that they have full legal authority to dispose of all Waste handed over to us and indemnifies us against any claims arising from unlawful disposal of items not lawfully in their possession.
9.3 Prohibited and hazardous items
Certain items cannot be accepted or may require special arrangements. The Customer must inform us in advance if any Waste includes hazardous materials, sharp objects, flammable substances, or items requiring specific disposal methods. We reserve the right to refuse such items or to apply additional charges where lawful and practical disposal is possible.
9.4 Recycling and reuse
Where feasible, we will seek to prioritise reuse and recycling of collected items rather than landfill disposal, in line with our environmental commitments and regulatory requirements.
10.1 Complaints
If the Customer is dissatisfied with any aspect of the Services, they should notify us as soon as possible, providing full details and any supporting information. We will investigate the matter and aim to respond within a reasonable time.
10.2 Resolution
We will use reasonable efforts to resolve complaints amicably, which may include repeating the Service where appropriate, offering a partial refund, or other remedial actions. Any remedy offered is at our discretion, subject to applicable consumer rights legislation.
We will collect and process personal data about Customers only as necessary to provide and administer the Services, including processing bookings, issuing invoices, and communicating about the work. Personal data will be stored securely and will not be sold to third parties.
We may share limited information with service partners, payment processors, or regulatory bodies where required to perform the Services, comply with legal obligations, or protect our legitimate interests.
We reserve the right to update or amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to that Contract. Any material changes will be made available on request.
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision will be deemed removed, and the remaining provisions will continue in full force and effect.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
By booking or receiving Services from House Clearance Wimbledon, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
